1. Acceptance of Terms

You must be legally able to enter into a contract with Atrable under the laws of your country. If you are a minor, a parent or legal guardian must review these Terms and is responsible for your use of the service. Organizations accepting these Terms must ensure the person acting on their behalf has authority to do so.

2. Eligibility and Account Security

You must be at least 13 years old, or the minimum age required in your region, to use Atrable. Provide accurate account information, safeguard your login credentials, and promptly notify us of any suspected unauthorized access. Parents, guardians, and account owners are responsible for all activity that occurs under their accounts, including activity performed by people they allow to use the service.

You may only create one account per individual. Automated account creation, account trading, or credential sharing is prohibited.

3. Privacy

Our Privacy Policy explains what data we collect (eg. profile details, diaries, chats, unlock events, device metadata, notification settings, and encrypted backups), how we use it, which third parties process it, and how you can manage or delete it. By using Atrable you consent to the handling of your information as described there.

4. Service Description and Availability

Atrable provides tools to create diaries, unlock friends' content, exchange end-to-end encrypted messages, maintain device key escrow, and manage encrypted backups. We may add, change, or remove features, pause the service for maintenance, or limit access when we detect abuse or security issues. Some functionality is experimental or may only be available in certain regions or device types.

5. Your Content and License to Atrable

You retain ownership of the content you upload. You grant Atrable a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce, and display that content solely for operating, improving, and securing the service, including enabling encrypted backups, facilitating unlock requests, indexing data for search, moderating abusive material, and delivering notifications. We only surface private or friends-only diaries to the audiences you select; this license does not allow Atrable to publicly display content you mark as restricted. You are responsible for the legality of everything you post.

6. Community Guidelines and Prohibited Conduct

Treat people with respect and follow all laws. Do not:

• Harass, threaten, defame, or impersonate others.
• Post sexual content involving minors or other exploitative imagery.
• Share malware, phishing content, or attempts to bypass our security controls.
• Use Atrable to spam, run bots, scrape data, or conduct unauthorized advertising.
• Infringe intellectual property or privacy rights.

Violations can result in content removal, feature restrictions, or account suspension.

7. Device Security, Encryption, and Backups

Atrable offers device verification tools and encrypted backup options that store an encrypted copy of your chat decryption key so you can restore access on another device if you lose the original. You are responsible for keeping your devices secure, approving or revoking new device sessions, and maintaining updated contact information. We may block devices or sessions that appear compromised.

8. Third-Party Services and Integrations

Atrable runs on infrastructure provided by services such as Firebase (Auth, Firestore, Storage, Cloud Messaging, Cloud Functions, and Data Connect), Google Cloud, Apple Push Notification service, Firebase Cloud Messaging, and Neo4j Aura for social graph search. We may also use vendors for analytics, fraud prevention, and customer support. Your use of those services is subject to their terms where applicable. We are not responsible for third-party websites or products linked through Atrable.

9. Intellectual Property

Atrable and its logos, product names, and code are owned by Atrable or its licensors. You may not copy, modify, reverse engineer, or create derivative works from our software or designs except where the law allows.

10. Beta Features and Feedback

Atrable frequently ships experimental features. These features might change rapidly, have limited support, or collect diagnostic data to help us stabilize them. If you send feedback or suggestions, you give us permission to use it without obligation to you.

11. Termination

You can delete your account at any time from the app settings. We may suspend or terminate your account if you violate these Terms, create risk or legal exposure for us, or fail to comply with applicable laws. Upon termination, we may retain necessary records to comply with legal obligations, secure the service, or resolve disputes.

12. Disclaimers

Atrable is provided on an AS IS and AS AVAILABLE basis. We do not make warranties about uptime, data accuracy, or fitness for a particular purpose. Because the service depends on internet, device, and third-party infrastructure, outages or data loss may occur.

13. Limitation of Liability

To the fullest extent allowed by law, Atrable will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim arose (or one hundred US dollars if you have not paid us).

14. Indemnification

You agree to indemnify and hold Atrable and our affiliates harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your content, your use of the service, or your violation of these Terms or applicable law.

15. Changes to These Terms

We may update these Terms to reflect product changes or legal requirements. If we make material changes, we will notify you by email, in the app, or through our website, and we will ask you to review and agree to the updated Terms the next time you launch the app after the update goes live. Continued use of Atrable after the effective date means you accept the updated Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Atlanta, Georgia for any dispute arising from the service.
